The rules of using Aloe.

These Terms of Service ("Terms") are a legal agreement between you and Studio Eastgate, LLC ("Aloe," "we," "us"). They cover the Aloe AI mobile app, the aloeai.app website, and any related services.

By creating an Aloe account, downloading the app, starting a free trial, or using any part of the service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Aloe.

Aloe is an AI nutrition coach that learns how your body responds to food. You log meals, you tell Aloe how you feel, and the coach helps you find patterns - which foods drain your energy, what tends to trigger bloating, what works for you. With your permission, Aloe also uses platform health data from Apple Health on iOS or Health Connect on Android to give better context to its suggestions.

Aloe is a wellness and educational tool. It is not a doctor, a dietitian, a therapist, or a medical device.

Aloe's suggestions are not medical advice, diagnosis, or treatment. They are general informational guidance based on the patterns the AI observes in your inputs.

Do not rely on Aloe to make medical decisions. Do not use Aloe to diagnose or treat any condition. If you have a health concern, a diagnosed condition, an allergy, an eating disorder, or any kind of medical emergency, talk to a qualified healthcare professional. If you may be experiencing a medical emergency, call your local emergency number immediately.

Aloe is not a substitute for professional medical advice. We make no claims that Aloe will diagnose, cure, treat, prevent, or mitigate any disease.

You must be at least 18 years old to enter into these Terms and create an account. Aloe is not directed to minors, and we do not knowingly allow anyone under 18 to use Aloe.

You must use Aloe in compliance with the laws of the country and jurisdiction where you live.

You create an Aloe account by signing in with Apple or Google. You are responsible for the activity that happens under your account. Keep your sign-in credentials secure, and let us know promptly if you suspect unauthorized access.

You agree to provide accurate information during onboarding - including height, weight, age, and any health conditions you choose to share. Aloe's coaching depends on this information being reasonably accurate.

Aloe is a paid subscription service. We offer two plans:

• Annual plan with a 7-day free trial, after which the plan auto-renews annually at the price shown in the App Store or Google Play purchase prompt at the time of purchase.
• Monthly plan with no free trial, which auto-renews monthly at the price shown in the App Store or Google Play purchase prompt at the time of purchase.

How billing works. Subscriptions are processed through your Apple ID on iOS or your Google Play account on Android. Apple or Google - not Aloe - charges your payment method, handles billing inquiries, and processes refunds. RevenueCat helps us manage subscription entitlement status across platforms. We never see your credit card information.

Free trial. If you start the annual plan, the 7-day free trial begins when you confirm the subscription in the App Store or Google Play purchase prompt. At the end of the trial, your store account will be charged for the first year of the subscription unless you cancel at least 24 hours before the trial ends.

Auto-renewal. Subscriptions renew automatically until you cancel. Your store account will be charged for the next period within 24 hours of the renewal date at the then-current price. You can review and manage auto-renewing subscriptions in your iOS Settings or Google Play subscription settings.

Price changes. We may change subscription prices for future renewal periods. If we do, Apple or Google will notify you in advance and ask for your consent when platform rules require it. Your existing renewal cycle is not affected.

Billing grace period. If a renewal payment fails, Apple or Google may retry it during a billing grace period during which you continue to have access. If the payment is not recovered, the subscription will end and access will be removed.

You can cancel anytime. To cancel:

• Open iOS Settings > tap your name > Subscriptions > select Aloe AI > tap Cancel Subscription.
• On Android, open Google Play> tap your profile icon > Payments & subscriptions > Subscriptions > select Aloe AI > tap Cancel subscription.
• Cancel at least 24 hours before the next renewal date to avoid being charged for the next period.

You will retain access to Aloe until the end of the current billing period.

Refunds are handled by Apple or Google. Aloe cannot process refunds directly. For App Store purchases, visit reportaproblem.apple.com and follow Apple's instructions. For Google Play purchases, use Google Play's refund request instructions. The store's refund policy applies.

You own everything you put into Aloe - your food logs, photos, feelings, chat messages, and any other content you create ("Your Content").

You give us a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and process Your Content for the limited purpose of running Aloe for you. That includes letting our AI provider process Your Content to generate Aloe's responses, and using de-identified, aggregated insights to improve the service.

We will not sell Your Content. We will not use it to train any third-party AI model. The license you grant us ends when you delete your account, except where retention is required by law or covered by our retention policy.

You promise that Your Content is yours to share - that you didn't take it from someone else, and that sharing it with Aloe doesn't violate any law or anyone else's rights.

Aloe uses third-party AI models, currently provided by OpenAI, to generate responses, nutrition estimates, and pattern observations. You understand that:

• AI output can be wrong. Calorie and macro estimates from photos or text are approximations, not measurements.
• Pattern observations are correlations from your inputs, not causal medical conclusions.
• Aloe may suggest you talk to a doctor or other qualified professional for any concern that goes beyond general wellness.

By using Aloe, you accept that AI output is provided as-is. You are responsible for the decisions you make based on it.

You agree not to:

• Use Aloe in any way that violates the law, infringes anyone's rights, or harms another person.
• Submit data about someone else without their permission.
• Try to reverse-engineer, decompile, scrape, or extract the AI models, prompts, or system behavior.
• Use Aloe to develop or train a competing product, model, or service.
• Bypass any access controls, abuse the API, or interfere with how other users experience the service.
• Use Aloe to provide medical advice, diagnosis, or treatment to others.
• Submit content that is harassing, defamatory, hateful, sexually explicit, or otherwise objectionable.

Aloe, the Aloe name, the Aloe logo, the app, the website, and all related software, designs, content, and trademarks are owned by Studio Eastgate, LLC or our licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Aloe for your personal, non-commercial purposes.

You may not copy, modify, distribute, sell, lease, or create derivative works of Aloe or any part of it. You may not remove or alter any copyright, trademark, or other notices.

Aloe integrates with services from Apple, Google, and OpenAI, among others. Your use of those services is also governed by their own terms and privacy policies. We're not responsible for their conduct or content.

Apple Health and Health Connect integrations are read-only. We do not write any data back to your HealthKit store or Health Connect. You can revoke health access at any time in iOS Settings or Android's Health Connect app permissions.

You can stop using Aloe at any time. To delete your account and your data, use the in-app delete account flow, visit our account deletion page, or email aloeai@studioeastgate.com.

We may suspend or terminate your access to Aloe if you violate these Terms, if we're required to by law, or if continuing to provide the service is no longer commercially reasonable. Where appropriate and feasible, we'll give you notice. If you have unused subscription time when we terminate without cause, we will work with Apple or Google to refund the prorated portion where platform rules allow it.

Sections that by their nature should survive termination - including ownership, disclaimers, limitation of liability, indemnification, and governing law - will survive.

Aloe is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

We don't warrant that Aloe's coaching will produce any particular health, weight, fitness, or wellness outcome. We don't warrant that AI responses are accurate, complete, or appropriate for your circumstances.

Some jurisdictions don't allow the exclusion of certain warranties. In those places, the exclusions above apply only to the extent permitted by local law.

To the maximum extent permitted by law, Aloe, Studio Eastgate, LLC, and our officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages - including lost profits, lost data, business interruption, or any physical or emotional harm - arising from or relating to your use of Aloe, even if we've been advised of the possibility of those damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of Aloe is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions don't allow these limitations. In those places, our liability is limited to the smallest amount permitted by law.

You agree to defend, indemnify, and hold harmless Aloe, Studio Eastgate, LLC, and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from (a) your use of Aloe in violation of these Terms, (b) Your Content, or (c) your violation of any law or third-party right.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The federal and state courts located in Delaware will have exclusive jurisdiction over any dispute that is not subject to arbitration as described below, and you consent to personal jurisdiction in those courts.

Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by emailing aloeai@studioeastgate.com. We'll try to resolve it within 60 days.

Binding arbitration.If we can't resolve a dispute informally, you and Aloe agree to resolve it through binding individual arbitration under the rules of the American Arbitration Association, rather than in court. Arbitration will be conducted in Delaware (or another location we agree on) and may be conducted by phone or in writing if you prefer. Either party may seek injunctive relief in court for intellectual-property or unauthorized-access claims.

No class actions. You and Aloe agree that any dispute will be brought only on an individual basis, not as part of a class, consolidated, or representative action.

30-day opt-out. You can opt out of the arbitration and class-action waiver above by sending written notice to aloeai@studioeastgate.com within 30 days of first agreeing to these Terms. The opt-out has no effect on any other section of these Terms.

We may update these Terms from time to time. If we make a material change, we'll notify you in the app or by email before the change takes effect. The "Effective date" at the top of this page always reflects the latest version. Continuing to use Aloe after a change means you accept the updated Terms.
